Restructuring and insolvency
In the area of insolvency law, we provide legal services to both creditors and debtors.
For creditors, we arrange the preparation and filing of insolvency petitions and the registration of claims, including secured claims. In addition, we represent creditors in creditor bodies and in executing pledges in insolvency proceedings. We also have experience with assessing the countervailability of a debtor’s conduct and returning assets to the estate.
We provide debtors with legal advice in defending themselves against harassing insolvency petitions. We provide services to debtors in bankruptcy or imminent bankruptcy consisting of preparation of a debtor’s insolvency petition, a petition for authorising a moratorium, a petition for authorising reorganisation, and preparation of a reorganisation plan. We also have practical experience with preparing pre-packaged reorganisation. In addition, we provide debtors with comprehensive advice in insolvency proceedings concerning administration of the enterprise and the management of assets in accordance with insolvency law. We also prepare for debtors proposals for debt relief.
We provide advice to the members of executive bodies in relation to their personal liability during the bankruptcy of legal entities under their management.
We represent debtors, creditors, and other persons in incidental disputes relating to the establishment of claims, excluding assets from the estate, and determining the invalidity of an act.
